1. Definition:

TPC (Thailand) Co Ltd. hereinafter referred to as the letting company, conveys the rental of a holiday home on behalf of the owner of your holiday home. When you book a holiday home via the letting company the following conditions apply.

2. Binding agreements:

The agreement shall enter into force and is binding on the parties when the deposit is paid. The tenant is responsible to carefully verify that the accuracy of the booking confirmation is correct. If the deposit or balance is not made on or before the due date, the tenant will be deemed to have made a formal cancellation.

2. Information on your holiday home:

Holiday rentals are usually privately owned and rented out fully furnished with beds and seats for the number of stated tenants and is equipped with glass, crockery, cutlery, kitchen utensils, quilts and cushions. Linen (sheets and towels) is in the dwelling and is included in the rent. The quality of holiday homes vary slightly, and also the interior decoration, furniture and general equipment are affected by the owner's taste. 4. Rent and fees:

The rent for your holiday home for the whole of the agreed period includes in the booking confirmation the right for the number of people stated to use your holiday home.
When the keys are returned so is the deposit, less any possible damage to be charged for in cash. The damage deposit is 5,000 THB and reimbursed when departing. The house, furniture, equipment and keys must be left in the same condition that it was found in. The final payment for use of electricity and water will take place at departure. If the use of electricity and water is more than 2,500 THB per rental period the cost over 2,500 THB is deducted from the deposit.
Rent, electricity, water and the deposit is listed on the letting company website and in the booking confirmation.

5. Payment:

The booking fee is 20% of the total amount of the rent and must be paid within 5 days of booking. Payment method is shown in the booking confirmation.
The final balance of the remaining cost shall be made no later than 30 days before the rental period comes into force. Payment method is shown in the booking confirmation.
There is a security deposit of 5,000 Baht (not included in the booking price). This must be paid in cash when you arrive. This will be refunded on check-out, as long as no damage has been done.
Use of electricity and water more than the amount included with the rental will be deducted from the deposit.
The rent and the security deposit are to be paid in Thai Baht.
If the booking is made less than 30 days before the rental period, the total amount of the rent and the security deposit is due immediately. Payment method is shown in the booking confirmation.

Bank Transfer
The tenant is responsible for all bank charges (transmission) that may occur in the tenant’s home country and also Thailand.

Credit Cards
The booking fee must be paid within 2 days of booking. Credit card payment method is shown in the booking confirmation.
When payment is made by credit card you will be billed in Thai Baht.

6. Changing a booking:

The tenant has the right to change an already confirmed booking for a fee. Changing a booking means changing to another rental property included in the letting company’s programs or also the amendment of arrival and / or departure dates, provided  however, that the number of previously booked and confirmed days are not to be reduced.
The fee for changing a booking is 2,000 Thai Baht.

7. Cancellation:

Payments for rental fees cannot be refunded, so it is especially important to review your insurance coverage.

8. Cancellation insurance:

The letting company recommends that the tenant take out an insurance policy for possible cancellation in case sudden illness, accident, or death leads to the holiday being cancelled.
The letting company cannot provide their customers with insurance for cancellation. Several insurance companies offer cancellation insurance in addition to family home insurance.

9.  Right of disposal

The holiday home during the letting period is only available for the tenant’s use, with the exception of gardeners, pool keepers etc. and the letting company’s area representative, who have the right to inspect your holiday home during the rental period.

10. Tenant obligations:

Check-in and transfer of keys at your holiday home is on the arrival date unless otherwise agreed. It is the renter's responsibility on arrival to check the inventory against the inventory list.
The holiday home may not, without special agreement, be used by more tenants than specified in the booking confirmation. The letting company area representative has the right to refuse to accept or charge extra for people in addition to the number shown in the booking confirmation, if you have not agreed this in advance.
The tenant and his travelling companions are required to care for the holiday home and follow the rules, instructions and regulations that apply. The tenant and his travelling companions are responsible for any costs associated with damage to the holiday home and its furnishings and equipment and for lack of care. Damage costs will be deducted from the deposit. In the event of major damage, repairs which exceed the value of the deposit are to be paid for in full before departure.
Insurance cover for the tenant and the tenant’s belongings during the rental period of the holiday home are to be arranged and paid for by the tenant.
Injuries, errors, or omissions which occur during the rental period, shall be communicated immediately to the letting company or area representative for action. This applies to everything from minor problems to more major damage. If the tenant does not immediately notify the letting company or area representative of injuries, errors, or omissions, everything will be considered as in order in your holiday home.
It is the tenant’s responsibility to clean the holiday home, and to empty the garbage during the rental period. The tenant shall clean the house and empty the garbage before departure, for it is not included in the final cleaning.
The tenant must not carry out painting, marking the walls, hang up painting hooks or similar measures.
The tenant may not sub-lease the property. Check-out and return of keys and the deposit is usually at 11.00 am on the day of departure unless otherwise agreed.

11. Letting company obligations:

The letting company is responsible that the accuracy of the description of your holiday home is correct. If the letting company is guilty of contract error (but not personal injury) the letting company’s liability is limited to the rental fee.

The letting company is not responsible for the tenant or his travelling companion’s acts or omissions. The letting company is not responsible for damage or loss suffered by the tenant or his travelling companions in any burglary. The use of your holiday home and its furnishings and equipment, including any swimming pool, playground, etc. are at the tenant's own risk.
If the tenant for reasons not caused by the letting company has not used their holiday home, the tenant cannot claim any compensation for it.

12. Agreement changes:

When booking confirmation has been sent, it is unlikely, but not entirely impossible a change of your holiday home arises. In the case of a major change, the customer has the right within 5 days after he received the information to cancel at no cost. Any rents and fees already paid (less any bank charges) will be refunded.
The letting company is entitled to change prices 30 days before the rental period begins if taxes or government fees change so that the rent is affected. If prices increase by more than 10% then the tenant has the right within 5 days after he receives the information to cancel at no cost. Any rent and fees already paid (less any bank charges) will be refunded.
If unforeseen circumstances prevent the use of your holiday home, the letting company has the right to terminate the agreement before the term comes into force, or during the rental period. In such cases the letting company will try to find an equivalent replacement holiday home for the tenant. If this is not possible, or the tenant for legitimate reasons declines the offer, any remaining rent and fees already paid (less any bank charges) will be refunded.

13. Force Majeure:

The letting company is not liable for damages arising from unforeseen obstacles, or other unforeseen events, which the letting company could not have avoided. If international law or national laws restrict or prevent the letting, the letting company accepts those provisions.

14. Legislation:

Thai law will apply for the duration of the rental period.
